This website is operated by Smartlake Motors on behalf of Isuzu Migori, an authorized Isuzu dealership based in Migori, Kenya. The website provides information about our vehicles, parts, services, and exclusive customer benefits. These terms apply to all users of the website, including registered account holders.

Section 02

Eligibility

You must be at least 18 years of age and a resident of Kenya to create a customer account. By registering, you confirm that the information you provide is accurate, current, and complete. We reserve the right to refuse account registration at our discretion.

Section 03

Customer Accounts

Registering for a customer account is free and voluntary. Your account allows you to:

• Access exclusive discounts and promotional offers available only to registered customers.
• Subscribe to and manage your newsletter preferences.
• Set up and manage product availability alerts.
• View your account history and preferences.

You are responsible for maintaining the confidentiality of your account credentials. You must not share your password with any other person. You are responsible for all activity that occurs under your account. Please notify us immediately at the contact details in Section 14 if you believe your account has been compromised.

Each person may maintain only one customer account. Creating duplicate accounts may result in suspension of all associated accounts.

Section 04

Exclusive Discounts & Offers

Registered customers may be offered exclusive discounts, promotional pricing, or special offers from time to time ("Offers"). All Offers are subject to the following conditions:

• Offers are available to eligible registered account holders only and may not be transferred or shared.
• Each Offer will specify its own validity period, applicable products or services, and any other conditions. These will be communicated at the time the Offer is made.
• Offers cannot be combined with other promotions unless expressly stated.
• We reserve the right to modify, withdraw, or expire any Offer at any time without prior notice, provided that any Offer already redeemed will be honoured.
• Offers have no cash value and may not be exchanged for cash or credit.
• Misuse or attempted misuse of any Offer may result in account suspension and cancellation of the Offer.

All purchases and services remain subject to our standard sales terms, and any Offer applies as a reduction or modification to the applicable pricing only.

Newsletter Subscription

You may subscribe to our newsletter via the blog page or through your account settings. By subscribing, you consent to receiving periodic emails from Isuzu Migori containing dealership news, vehicle updates, service information, and promotional content.

You may unsubscribe at any time using the unsubscribe link in any newsletter email or through your account settings. We will process opt-outs within 5 business days.

Newsletter content is provided for informational purposes only and does not constitute a contractual offer or binding commitment regarding any product, pricing, or availability.

Product Availability Alerts

Registered customers may request to be notified when a specific vehicle model, spare part, or product that is currently unavailable becomes available ("Availability Alert").

• An Availability Alert is a notification service only. It does not constitute a reservation, pre-order, or guarantee that the product will be available to you or at any specific price.
• Multiple customers may request an alert for the same product. Notification does not guarantee first right of purchase.
• We will send a notification by email or SMS when the product becomes available. Once the notification is sent, the alert is automatically fulfilled and removed from your watchlist.
• We are not liable for any delay, failure, or error in delivering an Availability Alert notification, or for any loss arising from a product becoming unavailable after a notification is sent.

Website Content & Accuracy

We make every effort to ensure that information on this website, including vehicle specifications, pricing, parts availability, and service details, is accurate and up to date. However, we cannot guarantee that all information is free from errors or omissions at all times.

Prices and product availability displayed on the website are indicative and subject to change without notice. All final pricing and availability will be confirmed by our sales team at the point of enquiry or purchase. Nothing on this website constitutes a binding offer to sell any vehicle, parts, or product at any stated price.

All content on this website, including text, images, logos, vehicle photography, and design elements, is owned by or licensed to Smartlake Motors and Isuzu Migori, or is used with the permission of Isuzu Kenya Limited. The Isuzu name, logo, and related trademarks are the property of Isuzu Motors Limited and are used under licence.

You may not copy, reproduce, modify, distribute, or use any content from this website for commercial purposes without our prior written consent.

Prohibited Conduct

When using this website and your customer account, you must not:

• Provide false, misleading, or inaccurate registration information.
• Attempt to access another user's account or any system not intended for public access.

• Engage in any conduct that disrupts, damages, or impairs the website or our systems.
• Use your account to claim Offers or Alerts on behalf of another person without our knowledge.

To the fullest extent permitted by Kenyan law, Smartlake Motors and Isuzu Migori shall not be liable for any indirect, incidental, or consequential loss arising from your use of, or inability to use, this website or its features, including account services, newsletter communications, or Availability Alerts.

Our total liability to you for any claim arising in connection with these terms or the website shall not exceed the value of any specific transaction or service directly at issue.

Nothing in these terms excludes liability for fraud, personal injury caused by our negligence, or any other liability that cannot be excluded under Kenyan law.

Section 11

Account Suspension & Termination

You may close your account at any time by contacting us. Upon closure, your personal data will be handled in accordance with our Privacy Policy.

We reserve the right to suspend or permanently terminate your account, without prior notice, if we reasonably believe you have:

• Violated any provision of these Terms of Service.
• Provided false registration information.
• Engaged in fraudulent or abusive use of any Offer or Availability Alert.
• Taken any action that may harm the reputation or operations of Isuzu Migori or Smartlake Motors.

Upon termination, all Offers and pending Availability Alerts associated with your account will be cancelled without compensation.

Governing Law & Disputes

These Terms of Service are governed by and construed in accordance with the laws of Kenya. Any dispute arising from or in connection with these terms, or your use of this website, shall be subject to the exclusive jurisdiction of the Kenyan courts.

We encourage you to contact us in the first instance to resolve any concerns informally before pursuing formal proceedings.

Changes to These Terms

We may update these Terms of Service at any time. We will notify registered account holders of material changes by email or by displaying a notice on the website. The effective date shown at the top of this document will reflect the most recent update.
